Neither State nor Federal laws governing labor standards require and employer to compensate an employee for travel time to or from the employee’s home and the job site. Travel from job site to job site is not considered as “Working Time” and will not be compensated in overtime. Northeast Data however, will compensate employees as a benefit for their travel time if a bid allows for the payment. If a bid was accepted from a customer and allows for travel pay, the employee will be compensated at the employee’s normal pay rate up to a maximum of 8 hours of travel per one-way trip in any given 24 hour period. Hours exceeding the 8-hour maximum will not be compensated for.
Employees will be responsible to provide personal transportation and arrive on all job sites within a 40-mile radius from the Northeast Data office. Employees will not be compensated hourly or travel pay for this travel. All travel outside a 40-mile radius will be compensated at the employees’ standard rate. Overtime will not be paid for travel. If travel is accumulated on a holiday, the employee’s standard rate will be paid and will not accrue any extra compensation. (Travel pay will only be disbursed if it is included in a customer contract 04/13/2009)
Managers who are expected to travel are not eligible for travel pay unless they have completed an 8-hour work day or if the hours exceed 40-working hours a week.
As per Pennsylvania State Labor Laws and Federal Labor Laws, all hours worked in excess of 40 hours during a normal pay period are to be considered and compensated for as Overtime Pay with the exception of travel / layover pay / vacation / sick / personal / holiday and / or bereavement pay.
Any / All overtime hours must be approved by your Manager prior to initiation. No employee will be paid for overtime hours without prior authorization.
Overtime compensation will be paid at a rate of 1 ½ times an employee’s regular pay rate for all hours worked over 40 hours during any given pay week, not including Holiday Work Hours. Travel time / Layover time is not considered hours worked and will not be compensated at the overtime rate.
Salary employees are not compensated with overtime pay unless it is specifically stated as a special project.
